- usernames
- passwords
- contact preferences
- contact or authentication data
- employer or company name and role

Sensitive Information. We process the following categories of sensitive personal information: (a) precise geolocation data, where a workforce user enables location permissions, captured at clock-in and clock-out and used solely to verify time and attendance at a job site; and (b) account log-in credentials (username in combination with password). We do not use or disclose sensitive personal information for any purpose other than those permitted under applicable law, and we do not use it to infer characteristics about you. You may have the right to limit our use and disclosure of sensitive personal information — see "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?" below.
Payment Data. If you choose to make purchases, the data necessary to process your payment — such as your payment instrument number and the security code associated with your payment instrument — is collected and processed directly by our payment processor, Stripe. We receive only limited transaction confirmation details. You may find their privacy notice link(s) here: https://stripe.com/privacy.

All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information — such as your IP address, device characteristics, and usage data — is collected automatically when you visit or use our Services.
We automatically collect certain information when you navigate the Services. This information does not reveal your specific identity but may include:
- Account and session data — session ID, device label, browser user-agent, and IP address, including the approximate city or region derived from it;
- Page-view and usage analytics — page URL, page title, referring URL, device type, browser, and operating system;
- A pseudonymous device identifier — a non-reversible hash of your user-agent string and screen dimensions;
- In-app activity events — form submissions and outbound link clicks; and
- Precise device geolocation — latitude, longitude, and accuracy, captured at clock-in and clock-out where the feature is enabled and device permissions are granted. This feature is optional and permission-gated, and you may disable it at any time in your device settings.

3. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We may share information in specific situations described in this section and/or with the following third parties.
We may need to share your personal information in the following situations:
- Service Providers and Processors. We share personal information with vendors that perform services for us under written contract and are permitted to use the information only to provide those services, including cloud hosting and storage, payment processing (Stripe), analytics, email and SMS delivery, customer support, and mapping and geocoding providers.

- AI Service Providers. We share inputs, outputs, and associated personal information with the AI Service Providers described in Section 5.
- Legal Obligations and Protection of Rights. We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, subpoena, or legal process, or where we believe disclosure is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, threats to the safety of any person, or as evidence in litigation.

We use certain Google Maps Platform APIs to retrieve certain information when you make location-specific requests. This includes: customer job site addresses (street, city, state, and ZIP, sent as the center parameter of a Static Maps request); geocoded coordinates derived from those addresses; and, where the feature is enabled, precise device geolocation. The full inventory of information we collect is described in "WHAT INFORMATION DO WE COLLECT?" above. A full list of what we use information for can be found in this section and in the previous section titled "HOW DO WE PROCESS YOUR INFORMATION?" Google Maps uses GPS, Wi-Fi, and cell towers to estimate your location. GPS is accurate to about 20 meters, while Wi-Fi and cell towers help improve accuracy when GPS signals are weak, like indoors. This data helps Google Maps provide directions, but it is not always perfectly precise. We obtain and store on your device ("cache") your location. You may revoke your consent anytime by contacting us at the contact details provided at the end of this document. The Google Maps Platform APIs that we use store and access cookies and other information on your devices. If you are a user currently in the European Economic Area (EU countries, Iceland, Liechtenstein, and Norway) or the United Kingdom, please take a look at our Cookie Notice.
4. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In Short: We may use cookies and other tracking technologies to collect and store your information.
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services and your account, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.
We also permit third parties and service providers to use online tracking technologies on our Services for analytics and advertising, including to help manage and display advertisements or to tailor advertisements to your interests. The third parties and service providers use their technology to provide advertising about products and services tailored to your interests which may appear either on our Services or on other websites.
To the extent these online tracking technologies are deemed to be a "sale"/"sharing" (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by using the "Your Privacy Choices" link in the footer of our website, by enabling a Global Privacy Control signal in your browser, or by submitting a request as described below under section "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?"
Specific information about how we use such technologies and how you can refuse certain cookies is set out in our Cookie Notice.
5. DO WE OFFER ARTIFICIAL INTELLIGENCE-BASED PRODUCTS?

As part of our Services, we offer products, features, or tools powered by artificial intelligence, machine learning, or similar technologies (collectively, "AI Products"). These tools are designed to enhance your experience and provide you with innovative solutions. The terms in this Privacy Notice govern your use of the AI Products within our Services.

As outlined in this Privacy Notice, your input, output, and personal information will be shared with and processed by these AI Service Providers to enable your use of our AI Products for purposes outlined in "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" You must not use the AI Products in any way that violates the terms or policies of any AI Service Provider.
We do not permit our AI Service Providers to use your inputs or outputs to train their models, and our agreements with them restrict use of your information to providing the AI Products to us. We do not use AI Products to engage in profiling that produces legal or similarly significant effects concerning you. If that changes, we will update this Privacy Notice, notify you, and, where required, offer you the ability to opt out of, or withdraw consent to, such processing before the new use begins.

6. HOW DO WE HANDLE YOUR SOCIAL LOGINS?
In Short: If you choose to register or log in to our Services using a social media account, we may have access to certain information about you.
Our Services offer you the ability to register and log in using your third-party social media account details (like your Facebook or X logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile information we receive may vary depending on the social media provider concerned, but will often include your name, email address, friends list, and profile picture, as well as other information you choose to make public on such a social media platform.
We will use the information we receive only for the purposes that are described in this Privacy Notice or that are otherwise made clear to you on the relevant Services. Please note that we do not control, and are not responsible for, other uses of your personal information by your third-party social media provider. We recommend that you review their privacy notice to understand how they collect, use, and share your personal information, and how you can set your privacy preferences on their sites and apps.
7. HOW LONG DO WE KEEP YOUR INFORMATION?
In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this Privacy Notice unless otherwise required by law.
We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). In determining the appropriate retention period, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, and applicable legal requirements. In general, we retain account information for the duration of your account plus a limited period thereafter, and we retain location and time-and-attendance records for the period required by our customer’s recordkeeping obligations and applicable wage-and-hour law.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
In the event of a security incident affecting your personal information, we will notify you and the applicable regulators as required by applicable data breach notification laws.
9. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 18 years of age, and we do not sell, share, or use the personal information of known minors for targeted advertising.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. We do not knowingly collect personal information from children under 13 years of age in violation of the Children’s Online Privacy Protection Act (COPPA). We do not knowingly sell or share the personal information of consumers we know to be under 16 years of age, and we do not process the personal information of a known minor under 18 for purposes of targeted advertising, sale, or profiling without the consent required by applicable law. By using the Services, you represent that you are at least 18 or that you are the parent or guardian of such a minor and consent to such minor dependent’s use of the Services. If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we may have collected from children under age 18, please contact us at privacy@bashbuilt.com.
10. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: You may review, change, or terminate your account at any time, depending on your country, province, or state of residence.
Withdrawing your consent: If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. You can withdraw your consent at any time by contacting us by using the contact details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below.
However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.
Opting out of marketing and promotional communications: You can unsubscribe from our marketing and promotional communications at any time by clicking the unsubscribe link in any marketing email, by replying "STOP" or "UNSUBSCRIBE" to the SMS messages that we send, or by contacting us using the details provided in the section "HOW CAN YOU CONTACT US ABOUT THIS NOTICE?" below. You will then be removed from the marketing lists. However, we may still communicate with you — for example, to send you service-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.

- Log in to your account settings and update your user account.
Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.
Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services.
If you have questions or comments about your privacy rights, you may email us at privacy@bashbuilt.com.
11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. We do, however, recognize and honor the Global Privacy Control ("GPC") signal as described below. If a further standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time, other than the Global Privacy Control signal described below.
Global Privacy Control: We recognize and honor Global Privacy Control (GPC) signals. If you use a browser or extension that supports GPC, we will treat this as a valid request to opt out of the sale or sharing of your personal information for targeted advertising purposes under applicable state privacy laws, including the California Consumer Privacy Act (CCPA). When we detect a GPC signal from your browser, we will automatically apply your opt-out preference without requiring you to take any additional action. For more information about GPC and how to enable it, visit globalprivacycontrol.org.

If your appeal is denied, you may submit a complaint to your state attorney general. You may submit an appeal within a reasonable period after receipt of our decision, and we will respond within the period required by applicable law, generally 45 days.
13. DO WE PROCESS INFORMATION ABOUT EMPLOYEES AND WORKFORCE USERS?
In Short: If you use the Services as an employee or contractor of one of our customers, we process your information on that customer’s behalf.
Where you access the Services as an employee or contractor of a Bashbuilt customer, that customer determines the purposes and means of processing your personal information and acts as the controller or business with respect to it. We process that information as a service provider or processor on their instructions. This includes your account and contact details, employer and role, time-and-attendance records, and, where enabled and permitted by you, precise geolocation captured at clock-in and clock-out.
If you wish to exercise privacy rights with respect to that information, please contact your employer directly; we will assist our customer in responding. Location tracking is limited to clock-in and clock-out events, is not used to monitor you outside of those events, and can be disabled through your device settings, although some time-verification features may not function if it is disabled.
14. DO RESIDENTS OF THE EEA, UK, OR SWITZERLAND HAVE SPECIFIC PRIVACY RIGHTS?
In Short: Yes. If you are located in the European Economic Area, the United Kingdom, or Switzerland, you have rights under the GDPR and UK GDPR.
Bashbuilt LLC is the controller of your personal information. We process your personal information on the following legal bases: performance of a contract with you; our legitimate interests in operating, securing, and improving the Services, where those interests are not overridden by your rights; compliance with a legal obligation; and your consent, where required, including for precise geolocation and non-essential cookies.
You have the right to request access to, correction of, or deletion of your personal information; to restrict or object to processing; to data portability; and, where processing is based on consent, to withdraw that consent at any time. You also have the right to lodge a complaint with your local supervisory authority.
Where we transfer personal information outside the EEA, the UK, or Switzerland, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses and the UK International Data Transfer Addendum.

If we make material changes to this Privacy Notice, we will notify you either by prominently posting a notice of such changes or by directly sending you a notification.
